Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees, in that employees
who operate powered industrial trucks were exposed to fall, crush and
struck by hazards when
loading and unloading unsecured trailers.
a)  Hearthside Food Solutions, LLC, on or about February 15, 2011, the
employer did not
ensure employees were protected from fall, crush and struck by hazards
when loading and
unloading semi trailers.  An employee was backing a forklift out of a
trailer when the spotter
pulled away from the dock causing the forklift to fall to the ground below
injuring an employee.
A feasible method of abatement, among others, would be to develop and
implement a dock
safety program for employees, which includes some or all of the following
provisions: a) System
for notifying the spotter driver when it is safe to enter and exit the
dock area. (dock lock system
or stop/go lights). b)  Policy prohibiting the spotter from moving
trailers in the dock area until
the spotter has effectively verified, or another employee has effectively
verified and
communicated to the spotter, that all the employees and equipment have
been removed from the
trailer and surrounding dock and yard areas.
In accordance with 29 CFR 1903.19(d), abatement certification is required
for this violation (
using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition,
documentation demonstrating that abatement is complete must be included
with your
certification.  This documentation may include, but is not limited to,
evidence of the purchase
or repair of the equipment, photographic or video evidence, or written
records.
