29 CFR 1910.272(g)(1)(ii):  All mechanical, electrical, hydraulic, and
pneumatic equipment
which presents a danger to employees inside grain storage structures were
not de-energized
and were not disconnected, locked-out and tagged, blocked-off, or
otherwise prevented from
operating by other equally effective means or methods:
(a)Marion Ethanol LLC dba POET Biorefining, 1660 Hillman Ford Road,
Marion, Ohio:  On or about June 7, 2011, the employer did not ensure that
the sweep
auger, used to move grain from the perimeter of bin #2 to the discharge
auger, was
de-energized and locked out while the workers were in the bin.  Workers
operated the
sweep auger while they remained in the bin to monitor and adjust the sweep
auger's
operation.
In accordance with 29 CFR 1903.19(d), abatement certification is required
for this violation (
using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition,
documentation demonstrating that abatement is complete must be included
with
your
certification.  This documentation may include, but is not limited to,
evidence of the
purchase or repair of the equipment, photographic or video evidence, or
written records.
