Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to struck/crush-by hazards from falling objects: a) Meldrum Mechanical Services, Inc. - Toledo, Ohio: On or about April 4, 2011, the employer did not ensure that the 5 ton Wright overhead hoist (underhung on bottom flange) had a functioning safety latch on the hook. The load and/or lifting devices could be dislodged from the hook as employees used the hoist and lifting devices to lift parts in the North area of the facility, exposing employees to crush injuries. b) Meldrum Mechanical Services, Inc. - Toledo, Ohio: On or about April 4, 2011, the employer did not ensure that the 5 ton Detroit overhead hoist (underhung on bottom flange) hook was equipped with a safety latch. The load and/or lifting devices could be dislodged from the hook as employees used the hoist and lifting devices to lift parts in the South area of the facility, exposing employees to crush injuries. Among other methods, one feasible and acceptable means of abatement is to follow The American Society of Mechanical Engineers (ASME) B30.16-2007: Overhead Hoists (Underhung). In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation ( using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.
