Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees, in that employees
were exposed to falls while working at elevated heights during repair work:
a) Independent Concrete Pipe Company - Sylvania, Ohio:  On or about
February 18, 2011, an
employee was exposed to a fall hazard while working from an extension
ladder which was
elevated in a platform that was supported by a Taylor THD 160 forklift.
The employee was
exposed to a fall hazard of approximately 20 feet in that the employee did
not remain on the
platform floor and used the ladder to gain additional height during repair
work on the Dry Cast
building's north overhead door motor.
Among other methods, one feasible and acceptable means of abatement is to
follow the
American National Standards Institute ANSI/ITSDF B56.1-2005: Safety
Standard
for Low Lift
and High Lift Trucks as applicable - 4.17.3, paragraphs: (p)  Personnel
are to remain on the
platform floor.  Use of railings, planks, ladders, etc., on the platform
for purpose of achieving
additional reach or height is prohibited; (h) Before elevating personnel,
mark area with cones
or other devices to warn of work by elevated personnel; (n) Have a trained
operator in position
to control the truck, or available to operate controls. When the operator
is not in the operating
position, engage the parking brake and block the wheels.
In accordance with 29 CFR 1903.19(d), abatement certification is required
for this violation
( using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in
addition, documentation demonstrating that abatement is complete must be
included with
your certification.  This documentation may include, but is not limited
to, evidence of the
purchase or repair of the equipment, photographic or video evidence, or
written records.
