Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were likely to cause death or serious physical harm to employees, as a
result
of working at or
near enclosed equipment used for handling combustible sugar dust which did
not contain
engineered explosion protection controls for primary deflagration hazards,
as a result of working
at or near equipment which allowed the escape of combustible sugar dust
into the working
environment, and as a result of working within building areas containing
secondary deflagration
hazards from settled layers of combustible sugar dust:
(a) AmCane Sugar, LLC - Toledo, Ohio: On or about July 8, 2011, the
process sieve and
associated material bin inside of the indoor process screening room did
not contain a method of
explosion protection.  The screening room contained both primary and
secondary explosion
hazards and did not incorporate pressure relief as an element of building
design. There was no
method to remove tramp metal upstream of the process sieve.
(b) AmCane Sugar, LLC - Toledo, Ohio: On or about July 8, 2011, the
magnetic separator on
the second floor of the process area contained multiple openings which
allowed for the escape
of combustible sugar dust into the surrounding area during production.
The process area
contained secondary explosion hazards and did not incorporate pressure
relief as an element of
building design.
AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE METHOD TO
CORRECT THIS HAZARD IS TO COMPLY WITH NATIONAL FIRE PROTECTION
ASSOCIATION (NFPA) STANDARDS: NFPA 61 "STANDARD FOR THE PREVENTION
OF FIRES AND DUST EXPLOSIONS IN AGRICULTURAL AND FOOD PROCESSING
FACILITIES (2008)" - SECTIONS 6.2, 6.3.1, 10.3.1, 10.4.10.1, AND  NFPA 654
"STANDARD FOR THE PREVENTION OF FIRE AND DUST EXPLOSIONS FROM THE
MANUFACTURING, PRCESSING, AND HANDLING OF COMBUSTIBLE PARTICULATE
SOLIDS (2006)" - SECTIONS 7.2.3.2.1. 7.2.3.3.1, 7.15.1, 7.15.2, 8.1.
In accordance with 29 CFR 1903.19(d), abatement certification is required
for this violation (
using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition,
documentation demonstrating that abatement is complete must be included
with your
certification.  This documentation may include, but is not limited to,
evidence of the purchase
or repair of the equipment, photographic or video evidence, or written
records.
