Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards from defective mobile ladder stands: Full Service Warehouse: On or about March 3, 2010, mobile ladder stands that had defects and were not taken out of service, were provided to employees to place and remove items from the racks: a) Ladder #1 in Aisle #34 was damaged and leaned a little. One support brace and the bottom braces were bent. b) Ladder #3 in Aisle 38 had a damaged cross bearing, bent lower braces and rear wheel was bent and did not roll effectively. c) Ladder #5 near access to merchandise area, the bottom braces were all bent. One of the two vertical braces below the bottom step was bent. Among other methods, one feasible and acceptable abatement method to correct this hazard is to develop and implement a program for regular inspections and maintenance of the mobile ladder stands.
