Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards associated with: Carrying materials on the top railing of the man basket of a JLG model # E450A aerial lift. Location: Jobsite Employees were exposed to struck-by hazards from falling lumber, where an employee had stacked 2"x 4" lumber on the top rail of the basket of an aerial lift, and carried the unsecured load over employees below. One feasable means and method of abatement, among others would have been to utilize the crane on the jobsite, which was equipped with a scale pan to safely transport the lumber.rt
