Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by and crushed by hazards associated with entering a box truck or trailer from the dock with a powered industrial truck: 1) Dock: Written procedures were not developed or used to ensure that trucks were not moved while a powered industrial truck was entering or leaving. An operator and forklift fell approximately four feet while entering a box truck when the truck moved. The operator experienced back injuries. Methods of abatement include but are not limited to: 1) Develop a written procedure and communicate and enforce the procedure. 2) Install a dock lock system. 3) Install a dock traffic light system. 2) Dock: An operator and a forklift fell four feet while entering a box truck to remove empties. The operator was not wearing a seat belt. The operator experienced back injuries. Methods of abatement include but are not limited to: 1) Retrain operators of forklifts who enter box trucks or trailers at the dock. 2) Conduct regualr inspections to ensure the use of seatbelts by the forklift operators.
