Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards associated with: At the site: On May 19, 2010 an employee from HowesTemco was instructed to remove a damaged extension cord from use. The employee was exposed to a fall of seven feet when he climbed up on top of a storage rack to complete the assigned task without any fall protection. Among other means, feasible means of abatement would have been to use a ladder which was available or the man-lift that was available.
