Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards associated with were exposed to the hazards associated with being crushed or struck by falling objects stored on damaged racks: Cooler Warehouse: On October 22, 2010, the bottom portions of the steel storage rack system used to store pallets of cranberries and cranberry products, were damaged in some areas. Among other methods, one feasible abatement method to correct this hazard is to: a) Provide column protectors and/or steel clad impact panels to reduce damage from forklift impact; b) Ensure that damaged racks are replaced or repaired according to manufacturer's recommendations; c) Establish regular inspections of rack systems to identify damaged racks; d) Follow safety practices outlined in the American National Safety Institute (ANSI) MH-16.2-1984 standard (or later version) for "Use of Industrial and Commercial Steel Storage Racks".
