North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North Carolina:  The
employer did not furnish to each of his employees  conditions of
employment and a place of employment free
from recognized hazards that were causing or likely to cause death or
serious physical harm to employees, in
that employees were exposed to fall/struck by hazards when a catwalk
system failed:
a)establishment, press No. 3 - the employer's employees routinely  walked
and worked on the
catwalk system that was corroded (rusted) and defective. On or about
October 3, 2009, nine
contractor employees were seriously injured when the catwalk component
they were on broke
away at the weld joints causing seven contractor employees to fall
approximately 17' (208") to
the concrete floor below and two contractor employees to be struck by the
falling platform.
Abatement note:
One feasible and acceptable abatement method is to include the inspection
and
maintenance of catwalk
attachment welds in their existing preventive maintenance program to
ensure the structural integrity and
prevent deterioration of the catwalk systems.
