North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards: a)site-on or about 09/13/09, employees unnecessary to the demolition operations were permitted in an area that could be adversely affected when demolition operations on a masonry wall were being performed. Abatement note: Among other methods, one feasible method to reduce the hazard would be to follow the requirements of the American National Standards Institute in ANSI A10.6- Safety Requirements for Demolition Operations, which states "No employee shall be permitted in any area that can be adversely affected when demolition operations are being performed. Only those employees necessary for the performance of the operation shall be permitted in these areas.
