North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North Carolina:  The
employer did not furnish each of his employees conditions of employment
and a place of employment free
from recognized hazards that were causing or likely to cause death or
serious physical harm to employees in
that employees were exposed to the struck-by hazard due to errors in hoist
operation resulting from inadequate
markings on the electric powered hoist:
a)facility, yard, boat hoist - the rated load of the electric powered
hoist was not marked on the
hoist so as to be legible from the ground.
b)facility, yard, boat hoist - the electric powered hoist was not marked
with the name of the
manufacturer, model or serial number, and the voltage.
c)facility, yard, boat hoist - the electric powered hoist was not provided
with a label displaying
information concerning operating procedures to include lifting over people.
ABATEMENT NOTE:
1)Among other methods, one feasible and acceptable abatement method to
correct these hazards
is to mark the hoist in accordance with ASME B30.16-2007, sections
16-1.1.1 Rated Load,
16-1.1.3 Identification, and 16-1.1.4 Warnings.

with an operational test.
c)facility, yard, boat hoist - the electric powered hoist was not provided
with a load test.
ABATEMENT NOTE:
1)Among other methods, one feasible and acceptable abatement method to
correct these hazards
is to inspect and test the hoist in accordance with ASME B30.16-2007,
sections 16- 2.1.1(a)
Initial Inspection, 16-2.2.1 Operational Testing, and 16-2.2.2 Load
Testing.

is to construct and inspect the hooks in accordance with ASME B30.10-2005,

North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North Carolina:  The
employer did not furnish each of his employees conditions of employment
and a place of employment free
from recognized hazards that were causing or likely to cause death or
serious physical harm to employees in
that employees were exposed to the struck-by hazard due to unsafe hoist
operation resulting from utilizing
attachment points on the load which were not rated for lift:
a)facility, yard - employees attached the hooks for the slings of an
electric powered hoist to a
boat, which weighed approximately 3,000 pounds, by means of the bow and
stern eyes on the
boat.  These eyes are not rated for lift and showed visible signs of
cracks, discoloring, and
corrosion.  On 10/07/09, this condition resulted in an accident in which
an employee received
fatal injuries when the port stern eye broke and the load became partially
disengaged from the
hoist.
ABATEMENT NOTE:
1)Among other methods, one feasible and acceptable abatement method to
correct these hazards
is to not use the bow and stern eyes for lift, but rather use other means
available, such as the
electric hoist with slings across the bottom of the hull, the boat
forklift, or yard arms to lift the
boat.

procedures being utilized:
a)facility, yard - employees attached the hooks for the slings of an
electric powered hoist to a
boat, which weighed approximately 3,000 pounds, by means of the bow and
stern eyes on the
boat rather than using the readily available slings, placed across the
bottom of the hull to
support the weight of the boat.  On 10/07/09, this condition resulted in
an accident in which
an employee received fatal injuries when the port stern eye broke and the
load became partially
disengaged from the hoist.
ABATEMENT NOTE:
1)Among other methods, one feasible and acceptable abatement method to
correct these hazards
is to not use the bow and stern eyes for lift, but rather use other means
available,
such as the
electric hoist with slings across the bottom of the hull, the boat
