North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North Carolina:  The
employer did not furnish each of his employees conditions of employment
and a place of employment free from
recognized hazards that were causing or likely to cause death or serious
physical harm to employees in that
employees were exposed to crushing hazards from vehicular traffic:
a)facility, PS&D loading bays - the employer failed to ensure that
employees preparing trailers
for loading were not in the path of tractor/trailers with restricted views
which were backing into
the loading areas.  This condition resulted in an accident on 11/17/09,
during which an
employee was struck and crushed between a tractor and a trailer.
b)facility, PS&D loading bays - the employer failed to ensure that
employees working in the
loading area were protected from the unexpected movement, in any
direction, of vehicles being
positioned at or moved away from loading bays. This condition resulted in
an accident on
11/17/09, during which an employee was struck and crushed between a
tractor and a trailer.
ABATEMENT NOTE:
1)Among other methods, one feasible and acceptable abatement method to
correct these hazards is
to require an observer or spotter, and a reverse alarm or tap the horn on
all
limited visibility
vehicles during all reversing operations to safely direct the truck and
trailer to the dock.
Develop and implement procedures for employees serving as spotters for
drivers, to include
where they will stand and how they will communicate with drivers (e.g.,
verbal, hand signals,
flags, etc.)
2)Among other methods, one feasible and acceptable abatement method to
correct these hazards is
to develop and implement a program  to ensure any movement by tractors
and/or trailers only be
made under the positive control of International Paper Company  employees.
This program may
include such items as tractor key control, wheel locking devices, and
specific rules for temporary
and long term parking.y
