North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall from a platform not securely mounted to a rough terrain forklift: a)site-employees working and riding in a job made work platform which was not securely attached to the forks or the lifting mechanism approximately 15 feet above the ground. (ref para 8.24.1(h) ASME B56.6-2002) One feasible means of abatement is to use an authorized work platform securely attached to the forks and lifting mechanism of the lift.
