North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: a)establishment - where employee(s) were retrieving or storing file boxes from the top storage rack system located 8' 4" above the floor while standing on the top step of a 6' Werner step ladder (unknown model #s). Abatement note: One feasible and acceptable abatement method is to use longer ladders. Reference: ANSI A14.5 1992 - American National Standard for Ladders - Portable Reinforced Plastic -safety requirements: 9.3.2 Climbing and Working Location.
