North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards: a)Equipment Shelter - the structure which is used to store the public works departments fleet vehicles and equipment is rotten and degraded to the point that it has become structurally unstable. The roof rafters and 1"x4" tin roof supports were showing signs of rot and decay. Also several of the joists had been sistered together for repair, and now these repairs are showing signs of rot. The wooden columns along the north and south sides of the shelter were out of plumb and showed signs of rot. In several areas the tin roofing was missing and peeling up. Abatement Note: One means of abatement would be to demolish and rebuild the structure, or repair the structure and have the repairs inspected by a licensed structural engineer.

North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by and/or caught in between hazards: a)Shop Area - the "SCAG" Turf Tiger zero turn riding mower, model #STT61A-27CH, serial #938 1624 equipped with a stowable roll over protection bar (ROPS) was not equipped with a seatbelt. Abatement note: One means of abatement would be to purchase and install a new seatbelt equipment on all equipment with roll over protection (ROPS) devices according to the manufacturer's requirements. Reference: "SCAG" power equipment model STT operators manual, section 2, page 6 - "Operating Instructions - 1. Securely fasten seat belt during operation of the machine." Warning label on tractor ROPS bar - "Always use the seatbelt when the ROPS is locked in the upright position."
