North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by/crushed-by hazards: a)site - where employees were standing with their lower legs and feet beneath three large wooden beams that were positioned at a height of approximately 24 inches on the raised forks of a JLG Gradall G6-42A Variable Reach Forklift (SN 0160006333). ABATEMENT NOTE: Among other feasible abatements, one applicable and feasible method to correct this hazard would be to prohibit individuals from standing or passing under the elevated portion of the rough terrain forklift truck, whether empty or loaded.
