North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Caught by hazards between tractor and earth. a)Maintenance yard - The John Deere compact utility tractor model #5200 with the roll over protection bar was missing its seat belt assembly. b)Maintenance yard - The John Deere compact utility tractor model #2150 with the roll over protection bar was missing its seat belt assembly. c)Maintenance yard - The Case backhoe tractor model #850K with the roll over protection canopy was missing its seat belt assembly. Abatement note: One means of abatement would be to purchase and mount the seat belt equipment on all equipment with roll over protection devices according to the manufacturer's requirements.
