North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North Carolina:  The
employer did not furnish each of his employees conditions of employment
and a place of employment free from
recognized hazards that were causing or likely to cause death or serious
physical harm to employees in that
employees were exposed to struck by hazards from vehicular traffic:
a)job site - where the employer failed to ensure employees working around
the loading of heavy
equipment and vehicular traffic were protected from the unexpected
movement, in any
direction, of traveling vehicles.  On or about 05/14/2010 this condition
resulted in an accident
where an employee was struck and crushed beneath a 3.5 ton service vehicle.
ABATEMENT NOTE:
1)Among other methods, one feasible and acceptable abatement method to
correct these hazards is to
require an observer or spotter, and a working reverse alarm or tap of the
horn
on all limited visibility
vehicles during all reversing operations to safely direct the vehicle.
Develop and implement procedures
for employees serving as spotters for drivers, to include where they will
stand and how they will
communicate with drivers (e.g., verbal, hand signals, flags, etc.),
