North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to being struck by a falling automobile: a)bay areas-a single pole hydraulic automobile lift that "bounces" , shakes, and leaks oil when a vehicle is being lifted for service, does not have an inspection history as prescribed by para 7.3, ANSI B153.1-1990. b)bay areas-safety latch on a single pole hydraulic automobile lift was rusted and had to be manually engaged when the lift was fully raised and repairs had not been made in accordance with Automotive Lift Institute Attachment B, Safety Tips. ONE FEASIBLE MEANS OF ABATEMENT IS TO ESTABLISH AND MAINTAIN AN INSPECTION PROGRAM IN ACCORDANCE WITH THE MANUFACTURERS RECOMMENDATIONS AND TO MAINTAIN ALL SAFETY DEVICES IN A WORKABLE AND REPAIRED CONDITION.

North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)bay area-single pole hydraulic automobile lifts used to raise cars and light trucks for servicing, were not marked with the information required in para 6.2, ANSI B153.1-1990. A FEASIBLE MEANS OF ABATEMENT IS FOR THE EMPLOYER TO DETERMINE THE MANUFACTURER OF THE LIFT AND HAVE THE DEVICE MARKED IN ACCORDANCE WITH THE REFERENCED STANDARD.
