North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards: a) job site - where employee(s) were operating a Hitachi pneumatic staple gun (unidentifiable model # and serial #) with a supplied air pressure of 140 psi. Abatement Note: One feasible and acceptable method to correct this hazard is limit air pressure to the manufacturer's specified operating pressure (70 - 120 psi) of the Hitachi pneumatic staple guns. Reference: ANSI SNT-101-2002; American National Standard for Power Tools -- Portable, Compressed-Air-Actuated, Fastener Driving Tools -- Safety Requirements for; Chapter 9, Section 1 "Safe Power Source". Reference: Danger Warning affixed to the staple gun by the manufacturer. The label was partially torn off.
