North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crush-by and/or struck-by hazards: a)work site - where employees were walking under the elevated portion of a Gradall 534D (serial # 343271) rough terrain forklift truck while supporting a load, without the operator in the cab. b)work site - where the employer left the load-engaging means for a Gradall 543D rough terrain forklift truck had the load-engaging mean in an elevated position while supporting a load, without an operator in the cab. ABATEMENT NOTE: a-1)One acceptable abatement method to correct this hazard is when unloading the load from the Gradall 534D rough terrain forklift truck, place barricades to prevent employees from walking underneath the load and once unloaded fully lower the load-engaging means. b-1)One acceptable abatement method to correct this hazard is to lower the load-engaging means fully before the operator leaves the vehicle. Reference a):Hazards are recognized and addressed in ASME B56.6-2002 paragraph 6.2.7; "Do not allow anyone to stand or pass under the elevated portion of any rough terrain forklift truck, whether empty or loaded." Reference b):Hazards are recognized and addressed in ASME 56.6-2002 paragraph 6.2.12; "Before leaving the operator's position: (a) bring rough terrain forklift truck to a complete stop; (b) place directional controls in neutral; (c) apply the parking brake; (d) lower load-engaging means fully, unless supporting an elevated platform; In addition, when leaving the rough terrain forklift truck unattended: (e) stop the engine; (f) if the rough terrain forklift truck must be left on an incline, block the wheels; (g) fully lower the load-engaging means."gaging
