Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which was free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to a crushing hazard when operating a trash compactor:
a. Where, at the time of the inspection, the Wastequip Accurate trash
compactor (serial
no. 69154/1203), which was manufactured with an interlock switch that was
engaged
when the gate was closed, was operated without the switch functioning.
Among other methods, one feasible and acceptable abatement method to
correct the
hazard includes compliance with the American National Standards Institute,
ANSI Z245.2
(6.n), and the manufacturer's requirements, which requires inspection of
the equipment
to ensure the interlock is functioning and not permit an employee to
operate the
equipment unless the interlock and gate enclosure is functioning.
