Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
On or about November 5, 2009 an employee was observed and photographed
getting into and
riding in the bucket of a Link Belt C-Series II excavator to look into the
back of the dump truck.
Riding in the bucket exposed the employee to a potential crushing hazard
in the excavator's
articulating arm and a fall hazard in excess of 7' to the ground.
Among other methods one feasible and acceptable method to correct this
hazard would be to
place a ladder against the truck for access as well as follow the
Association of Equipment
Manufacturers safety manual for excavators which states, "Never use an
attachment for a work
platform or personnel carrier."
