Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to a fall hazard while using a platform on the forks of a
forklift:
A maintenance employee operating a forklift with an employee inside the
elevated safety
platform on the forks was exposed to a fall hazard due to the lack of
adequate standard guard
rail system (height of chains 28 3/4 inches and 32 1/2 inches respectively
without a mid rail on
two sides of the platform) no protection against moving parts of the
truck, and an effective
means to properly secure the platform to the forklift.
Among other methods, one feasible and acceptable method to correct this
hazard is to follow the
guidelines in the American National Standard Institute ANSI/ITSDF
B56.1-2005, Safety
Standard for Low Lift and High Lift Trucks, Section 7.37.1.  Platforms
used for elevating
personnel shall have (a) a slip resistant floor surface (b) a minimum
floor space of 17.12 inches
for each platform occupant (c) protection for personnel in their normal
working position from
moving parts of the truck that represent a hazard (d) restraining means
such as a guard rail
whenever the platform can be elevated to a height greater than 48 inches
(e) a guardrail shall
have a height above the platform floor of not less than 36 inches or more
than 42 inches around
the upper periphery and include a midrail.
