North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: a)jobsite, on 09/23/2009, an employee was observed standing on the midrail of a JLG 1930ES scissors lift to install a HVAC transition to a riser approximately 13 feet above the concrete floor. A feasible method for correcting this hazard is to follow the JLG Operations and Safety Manual which states "Keep both feet firmly positioned on the platform at all times."m
