Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that an employee was exposed to struck-by hazard while operating an All Terrain Vehicle (ATV): a) At the establishment, an employee operating an All Terrain Vehicle (ATV) was not provided training in the safe operation of the vehicle. One feasible and acceptable abatement method, among others, is to provide training to employees who will operate All Terrain Vehicles (ATVs) on their safe operation, before they are allowed to operate the vehicle.
