NYSLL Article 2, Section 27-a.3.a(1):  The employer did not
furnish to each of its employees, employment and a place of
employment which was free from recognized hazards that are causing
or were likely to cause death or serious physical harm to its
employees in that employees were exposed to  dangers of falling
vehicles caused by inadequate maintenance of vehicle lifts.
In applying this paragraph, fundamental distinctions between
private and public employment have been recognized.
a) Gilboa-Conesville CSD Bus Garage -  The employer did not
furnish employment and a place of employment which were free from
recognized hazards that were causing or likely to cause death or
serious harm to employees in that employees were exposed to
dangers caused by inadequate maintenance of vehicle lifts. The
employer failed to adequately maintain the automotive lift in the
Gilboa-Conesville CSD bus garage in that following the annual
ANSI/ALI ALOIM inspection performed. It was recommended by
Operations Manager that the Mohawk Lift Model TR-25A Serial Number-
AOE156 be removed from service due to failure to meet the ANSI/ALI
ALOIM Safety Inspection Guidelines. Among the factors that caused
the lift to fail inspection were ;(1) The Lock Out Safety Kit for
lifts which is required to be on site via ANSI Z244 is not
available. (2) Lifting chains are worn and need to be replaced to
maintain safe lifting. (3) Wheels free device which is a jack that
travels on the inner rails of the lift that lifts the vehicle to be
able to work on the tires. The snap ring, washer and axel pin need
replacement, which could cause pinch points between the lift and
brake drum assembly through the loss of pressure. Through employee
interviews it was determined that this lift is used daily by
employees.
Note:  One feasible and acceptable abatement method would be to
have a qualified lift repair company perform required maintenance
to return the Mohawk Lift Model TR-25A Serial Number-AOE156 to
compliance with ANSI/ALI ALOIM 2000.

that employees were exposed to injuries caused by improper use of
vehicle lifts.
a) Gilboa-Conesville CSD Bus Garage - ): The employer did not
furnish employment and a place of employment which were free from
recognized hazards that were causing or likely to cause death or
serious harm to employees in that employees were exposed to
dangers caused by inadequate training on vehicle lifts. The
ANSI/ALI ALOIM-2000 Page 5 Paragraph 4.2.1 "The owner or employer
shall ensure that operators of automotive lifts are instructed in
the safe use and operation of the lift using the manufacturer-
provided instructions and warning labels and the Automotive Lift
Institute publications and warning labels. Through employee
interviews it was determined that no training program or
instruction for the safe use and operation were provided.
Note: One feasible and acceptable abatement method would be to
follow the requirements of the American National Standard
Institute/Automotive Lift Institute - Automotive Lift Operation,
Inspection and Maintenance (ALOIM) 2000 training using the
manufacturer-provided instructions and warning labels and the
Automotive Lift Institute publications and warning labels.
