Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falling and being crushed by equipment: a.On or about January 22, 2010, an employee was exposed to the hazard of falling and being crushed by equipment while being transported in the bucket of a front end loader. Feasible and acceptable methods of abatement to correct the hazard include, but are not limited to the following: 1.Conform to the operators' manual safety directive stating not to haul personnel in the bucket of the Caterpillar model 938H Loader. 2.The employee could ride in another vehicle available at the job site. 3.The employee could walk to the destination. ABATEMENT CERTIFICATION AND DOCUMENTATION ARE NOT REQUIRED.
