Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by vehicular traffic: a.On or about May 18, 2010, an employee was exposed to the hazard of being struck by a Gehl DL-6L telescoping rough-terrain forklift, serial number 6L44JS0225551 that was traveling on the roadway in the same direction as the pedestrian's travel. Among other methods, feasible and acceptable means to abate this hazard are: 1.Remind pedestrians through re-education and enforcement aobut walking facing traffic and being alert of potential vehicular hazards; 2.Develop designated pedestrian-only and/or vehicle-only routes of travel; 3.Install and designate specific pedestrian safety zones where pedestrians and vehicles travel the same routes.
