Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to hazardous concentrations of VM & P Naphtha:
a.On or about September 15, 2010, two spray painters were exposed to the
hazards
of headaches, dizziness, nausea, narcosis and central nervous system
depression
which are associated with excessive levels of exposure to VM & P Naphtha
while
they were spray painting the ceiling of the building with Glidden
Professional SB
Dry Fall Semi-Gloss.
1.One spray painter had three - 15 minute samples with exposure levels to
VM & P Naphtha determined to be 1814.7, 2022.9, and 5932.0
milligrams per cubic meter (mg/m3).
2.One spray painter had one - 15 minute sample with exposure to VM & P
Naphtha determined to be 5835.3 mg/m3.
Among other methods of feasible and acceptable means to abate this hazard
are, such as but not
limited to:
1.Maintain employees' exposure levels to VM & P Naphtha below the
NIOSH recommended ceiling exposure limit of 1,800.0 mg/m3 (a 15
minutes exposure period).
2.Develop a comprehensive, periodic air contaminant sampling program;
improve local ventilation in the work area; and provide and ensure the
proper use of respiratory protection.
3.Substitution with a paint which do not contain VM & P Naphtha;
4.Modify the work practices to increase the distance between the chemical
source and the route of exposure (nose, eyes, mouth and/or skin) by using
long handled nozzles or lowering the height at which the scissor lifts are
set to reach the ceiling.
