Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck-by vehicular traffic: (a)On U.S. Highway 31, east of Flomaton near mile marker 53: On or before December 10, 2009, the exposing employer did not ensure that each employee performing guard rail cleaning activities within the workzone was wearing a warning vest or other suitable garments marked with or made of reflectorized or high-visibility material. Among other methods, recognized and feasible means of abatement to correct this hazard is to: a)Ensure that employees are provided with suitable traffic vests. b)Comply with the applicable elements required by the manual of Uniform Traffic Control Devices (Millennium Edition), June 2001, when performing work that affects highway and street traffic.
