Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: On or about December 7, 2009 and at times prior thereto, with respect to the jobsite located at 109 Goodgame Rd in Camden, Arkansas where employees were engaged in roofing activities at the new county jail complex. Employees were operating a Gehl RS6 42 extensible boom rough terrain forklift. The employees were not wearing the seat belts provided by the manufacturer. This practice exposed the employees to caught in and crushing hazards in the event of a roll over. Among other methods, one feasible and acceptable abatement method is to comply with ANSI B56.6-2005 Paragraph 6.2.1 "Safety Standard for Rough Terrain Forklifts" which states: Before starting to operate the rough terrain forklift truck: (a) be in the operating position and fasten the seat belt, if so equipped. Abatement disclaimers: 1. The employer is not limited to the abatement methods above. 2. The recommended abatement method may not be effective in all circumstances. 3. The employer is responsible for selecting an appropriate abatement method.
