Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: On or about December 9, 2009, and at times prior thereto, at the job site located at 18431 Shepherd Springs Road, Mountainburg, Arkansas, the employer did not ensure that all forming rods and pipes approximately 6 to 12 inches high and 1/2 inch in diameter were guarded, exposing employees to the hazards of impalement. Among other methods, one feasible and acceptable abatement method to correct this hazard is to ensure that steel forming stakes and pipes are capped/guarded to eliminate the impalement hazard.
