Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to potential falls while while loading the ball mill from a pallet elevated on the forks of a fork lift truck. a) Manufacturing Area - On or about 11/19/09, an employee was observed loading the ball mill while standing on a pallet which was elevated approximately 10-11' by a fork lift truck. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THIS CONDITION IS TO COMPLY WITH THE REQUIREMENTS OF ANSI B56.6 SECTION 5.15 WHICH INCLUDES: 1) Prohibit employees from using an elevated pallet as a work platform. 2) Use a rolling staircase to access and load the ball mills. 3) Provide a personnel platform which complies with the design requirements of this Section 4) Provide a permanent platform around the tanks which an employee can work on. ABATEMENT CERTIFICATION REQUIREDATION
