Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the rotating blade when the power is restored and the saws
start up:
(a) Tool Room, South Wall - The Do All vertical band saw, Model Number
2013 used to cut
metal parts, was not equipped with a magnetic restart or equivalent
device.  The saw was last
used on or about November 12, 2009.
(b) Tool Room, South Wall - The Kalamazoo horizontal band saw used to cut
metal parts, was
not equipped with a magnetic restart or equivalent device.  The saw was
last used on or about
November 12, 2009.
Among other methods, one feasible and acceptable method to correct this
hazard includes but
not limited to the following:
Conform to ANSI the American National Standards Institute for Safety
Requirements for Metal
Sawing Machines, ANSI B11.10 - 2003, Section 6.11 which states" The
machine controls shall
incorporate a type of drive motor starter that will disconnect the drive
motor from the power
source in the event of the control voltage or power failure system
failure" and National Fire
Protection Association - NFPA 79 -2007, Section 7.5.3 "Upon restoration of
the voltage or upon
switching on the incoming supply, automatic or unintentional restarting of
the machine shall be
prevented when such a restart causes a hazardous condition."
No abatement certification or documentation is required for this item.
