Labor and Employment Article, Section 5-104(a): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: (a)Date of Violation:11/06/09 Condition:An employee operating a motor vehicle in reverse, with an obstructed view in the rear, did not ensure, through proper positioning or visual or verbal contact, that ground personnel were clear from being struck-by or crushed by the moving vehicle. Among other methods, one feasible and acceptable abatement method to correct the hazard is to instruct and ensure compliance of the manufacturer's warnings in the Vehicle Operation section of the vehicle's Operator's Manual.
