Section 5(a)(1) of the Occupational Health and Safety Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that are likely to cause traumatic injuries, serious physical harm or death from vehicle traffic to his employees; a) At least thirteen (13) rear loading waste compacting trucks were observed with missing or deficient retro reflective sheeting markings which reduces the conspicity of the vehicle. As observed at the Republic Service yard on or about November 24, 2009. ABATEMENT NOTE: Among other methods, one feasible and acceptable method to correct this hazard is to comply with the American National Standard Institute (ANSI) Z245.1-2008 "Mobile Wastes and Recyclable Materials Collection, Transportation and Compaction Equipment - Safety Requirements. Section 7.2.16.5 "vehicle conspicuity for rear-loader vehicle" requires a strip of two inches wide retro reflective tape bellow the hopper and not less than 375 mm (15 inches) above the road surface.
