General-duty citation text
Section 5(a)(1) of the Occupational safety and Health Act of 1970: the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a. On or about November 20, 2009 - at the above addressed jobsite, employees were required to hang a banner on the side of shipping containers stacked approximately forty(40) feet above the ground. The employees were lifted to the top of the shipping containers by standing on top of a separate shipping container supported by the lifting attachment of a Taylor Empty Container Handler. The employees were not protected from falling up to forty(40) feet to ground level. Feasible and acceptable abatement methods include, but are not limited to: Following the Taylor Machine Works, Inc Safety Check 2nd Edition Manual which states " Do not use an improperly equipped forklift to lift personnel".
