Section 5(a)(1) of the Occupational Safety and Health Act of 1970: the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: Tootsie Wrap Hallway - On or about January 8, 2010, an employees was raised approximately 11 feet on the forks of a forklift to extinguish a fire in an air handling motor. Adequate procedures were not implemented to prevent the employee from falls to the ground. Among other methods, feasible and acceptable abatement methods include following the requirements for lifting personnel explained in the ANSI/ASME B56.1 - 2000 Safety standard for Low and High Lift Trucks.
