Section 5(a)(1) of the Occupational safety and Health Act of 1970:  the
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees:
a.  On or about April 14, 2010, at the above addressed jobsite, an
employee was installing a
metal panel to the exterior of the building, using a Skyjack SJIII4632
scissors lift.  The
employee climbed over the top and midrail to a plank which was secured to
the platform on the
outside of the guardrails, thereby exposing the employee to a fall of
approximately thirty two
(32) feet.  Among other methods, feasible and acceptable means to correct
these hazards are to
use a safe alternate method, such as: Comply with the Equipment
Manufactures Institute (EMI)
Aerial Platform Safety Manual which states: "Never use ladders, planks,
steps or other devices
to provide additional reach or gain greater height.  Do not lean over or
sit or climb on the
platform railing.  Always keep both feet on the platform floor at all
times."m

employee attached a lanyard to the guardrail, thereby exposing the
employee to a fall of
approximately thirty two (32) feet.  Among other methods, feasible and
acceptable means to
correct these hazards are to use a safe alternate method, such as comply
with operators manual
which states: "Use this ring as an attachment point for safety harness
tethers.  DO NOT attach
harnesses to any other point on the platform."
