Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were potentially exposed to an oxygen-deficient or toxic atmosphere associated with carbon dioxide: On or about April 19, 2010, in the facility, employees were not adequately protected against the release of carbon dioxide and an oxygen-deficient or toxic atmosphere in that: a. A pressure-relief device (valve) for the carbon dioxide system was located inside the building in the process room and not piped to the outdoors to prevent an oxygen-deficient or toxic atmosphere in the event of over-pressurization in liquid carbon dioxide storage tank. b. The process room where employees operated equipment (mixer, freeze tunnel) that used carbon dioxide was not provided with a gas detection and alarm system to warn employees of a release of carbon dioxide in excess of the permissible exposure limit (PEL). Among other methods, feasible and acceptable methods to control these hazards are to follow the safety requirements as prescribed by NFPA 55-2010, "Compressed Gases and Cryogenic Fluids Code" and CGA G-6.1-2005, "Standard for Insulated Liquid Carbon Dioxide Systems at Consumer Sites", specifically: a. Vent pressure relief devices (valves) to the outdoors where the discharge will not impinge on the structure, personnel, or means of egress and will not create a hazardous concentration of carbon dioxide (NFPA Section 13.1.1.2). b. Provide a monitoring system for areas in which carbon dioxide could accumulate such as the process room (CGA Section 4.5).
