Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
a place of employment which were free from recognized hazards that were
likely to cause death
or serious physical harm to employees:
a. On or about April 28, 2010, at the above addressed jobsite, employees
performing
landscaping operations were exposed to the hazards of being struck by
vehicular traffic while
working in the right lane of the southbound side of Larkin Avenue in
Joliet, IL. The lane was
closed with a company vehicle which was not equipped with signs, special
lighting or other
appropriate warning devices.
A feasible means of abatment would be to conform with Part VI of the
Manual of Uniform
Traffic Control Devices (MUTCD), 2009 Edition which states: Mobile
operations shall have
appropriate devices on the equipment (that is, high intensity rotating,
flashing, oscillating, or
strobe lights, signs, or special lighting), or shall use a separate
vehicle with appropriate warning
devices.ate
