Section 5(a)(1) of the Occupational safety and Health Act of 1970: the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a. On or about May 12, 2010, at the above addressed jobsite, an employee was performing welding operations from the bucket of a Case 75XT Skid Steer Loader, the employee was thereby exposed to injuries from falls created by the improper use of the Skid Steer Loader. One feasible and acceptable abatement method includes, but is not limited to the following: a. Follow the Manufactures Institute (EMI) safety manual for users and operators of skid steer loaders which states, "Never use the bucket for a work platform or personnel carrier."
