Section 5(a)(1) of the Occupational safety and Health Act of 1970: the
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees:
a. On or about May 19, 2010, at a jobsite located at 17725 Torrence
Avenue, Lansing, Illinois -
an employee installing Tvek to the exterior of a building using a Grove
Model 3610 Scissor lift
was exposed to fall hazards of approximately thirty eight (38) feet above
ground.  The employee
climbed onto the midrail of the basket to perform work activities, thereby
exposing the employee
to fall hazards.
Among other methods, feasible and acceptable means to correct these
hazards are to use a safe
alternate method, such as, but not limited to Comply with the Equipment
Manufactures Institute
(EMI) Aerial Platform Safety Manual which states: "Do not lean over, sit,
or climb on the
platform railing. Always keep both feet on the platform floor at all
times."m
