Section 5(a)(1) of the Occupational safety and Health Act of 1970: the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a. On or about October 8, 2010 - at the above addressed jobsite, the employer did not direct or make available a groundsman lookout during operation of a JLG Model 60HT Articulating Boom Lift. During this operation the operators vision was obstructed due to working height and the work being performed. The employees on the ground were thereby exposed to being struck by the JLG Model 60HT Articulating Boom Lift.One feasible and acceptable method to correct this hazard, among other means, would be to direct or make available an employee to serve as lookout in the event of the operator's view becoming obstructed in accordance with the JLG Model 60HT Operators and Safety Manual, dated 15 January 1985.
