Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that  employees were
exposed to the hazard(s) of being struck-by or crushed-by:
(a)On or about 01/12/10 - Outside Office, an employee was exposed to
struck-by
hazards while operating a Toyota forklift in that, the employee was not
using the
restraint system, was operating the forklift with an obstructed view and
was not
trained or certified to operate the forklift.
Among other methods, one feasible and acceptable method to correct these
hazards would be to
(1) Ensure that all forklift drivers utilize the restraint devices
provided on the forklifts, as stated
in ASME B56.1-1993-Safety Standard for Low Lift and High Lift Trucks; (2)
Ensure that
drivers operate forklifts facing the direction of travel with a clear view
as
stated in ANSI/ITSDF
B56.1-2005 Safety Standard for Low Lift and High Lift Trucks, Section
5.3.6; and (3) Ensure
that all operators of Power industrial trucks are competent to operate a
power industrial truck
safely as per ANSI/ITSDF B56.1-2005 Safety Standard for Low Lift and High
Lift Trucks,
Section 4.19.

employer did not

employees in that employees
were exposed to electrical hazards.
(a)On or about 01/12/10 - Dirt Room, Bottom of the steps next to the dirt
machine,
the cover on a 4x4 pull box was missing allowing the wires to be exposed.
(b)On or about 01/12/10 - Dirt Room, on the intake side of the dirt
machine,
a cord
servicing the dirt machine did not have strain relief.
(c)On or about 01/12/10 - Green House, a shop-made extension cord was made
out
of parts designed for permanent installation and was missing the cover.
(d)On or about 01/12/10, - Green House, employees were using extension
cords that
had the grounding prong removed.
(e)On or about 01/12/10, - Green House, employees were using an air
compressor
with a cord that had the grounding prong removed.
Among other methods, feasible and acceptable methods to correct these
hazard(s) are to place
a cover over the 4x4 box, provide strain relief on the cord servicing the
dirt machine, discard
the shop made extension cord, discard the extension cord missing the
ground plug, and repair
the cord servicing the air compressor.

employees in that employees
were exposed to falls.
(a)On or about 01/12/10 - Dirt machine access stairs - Fixed stairs were
not installed
at the proper angles, uniform combinations of rise and tread dimensions
were not
used to provide employees safe access to the work platform, and mid-rails
were
missing on both sides of the access stairs to the work platform.
Among other methods, one feasible and acceptable method to correct this
hazard is to build the
stairway in accordance with ANSI/ASSE A1264.1-2007, Safety Requirements
for Workplace
Walking/Working Surfaces and Their Access; Workplace Floor, Wall and Roof
Openings; Stairs
and Guardrail Systems.
