Labor and Employment Article, Section 5-104(a): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: (a)Date of Violation:11/25/09 Condition:When a vehicle is being operated in reverse, the operator did not ensure that the area behind the vehicle is clear. Among other methods, one feasible and acceptable abatement method to correct this hazard is to ensure that the area behind the vehicle is clear in accordance with ANSI Z245.1-2007 6.2.3.2(f) Mobile Wastes and Recyclable Materials Collection, Transportation, and Compaction Equipment - Safety Requirements. (b)Date of Violation:11/25/09 Condition:An employee crossed or stood behind a vehicle operating, or about to operate, in reverse. Among other methods, one feasible and acceptable abatement method to correct this hazard is to not stand behind a vehicle operating, or about to operate in reverse in accordance with ANSI Z245.1-2007 6.2.3.2(g) Mobile Wastes and Recyclable Materials Collection, Transportation, and Compaction Equipment - Safety Requirements. (c)Date of Violation:11/25/09 Condition:The locations of all co-workers were not known before operating a vehicle in reverse. Among other methods, one feasible and acceptable abatement method to correct this hazard is to make sure of the locations of all co-workers is known before operating the vehicle in reverse in accordance with ANSI Z245.1-2007 6.2.3.2(h) Mobile Wastes and Recyclable Materials Collection, Transportation, and Compaction Equipment - Safety Requirements. Abatement documentation (photographs, receipts, copies of programs, training certification, etc.) is required for this item.

Labor and Employment Article, Section 5-104(a): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: (a)Date of Violation:11/25/09 Condition:An employee was not wearing any high visibility apparel, such as a reflective safety vest, while placing trash into the rear hopper of the trash collection vehicle, located on a public street, exposing the employee to struck-by hazards from passing motor vehicles. Among other methods, one feasible and acceptable abatement method to correct this hazard is for all employees to wear high visibility apparel while outside of the truck cab of the trucks while collecting the trash. In accordance with ANSI Z245.1-2007 6.1.7.8 Mobile Waste and Recyclable Materials Collection, Transportation, and Compaction Equipment - Safety Requirements. Abatement documentation (photographs, receipts, copies of programs, training certification, etc.) is required for this item.
