furnish employment and a place of
employment which were free from recognized hazards that were causing or
likely to cause death or serious
physical harm to employees:
(a)Date of Violation:02/17/10
Location:Murphy Cottage/Re-Direct Unit
Condition: A Resident Advisor was not posted in the basement classroom
during a resident-
teacher meeting.
Among other methods one feasible and acceptable abatement method to
correct this hazard is to adhere to the
Cheltenham Youth Facility, Facility Operating Procedures 004, Titled:
Supervision and Movement, effective
date January 12, 2005 and review date January 12, 2006 which requires
staff to be posted inside the classroom
and provide supervision during classroom instruction.
Abatement documentation (photographs, receipts, copies of programs,
training
certification, etc.)
is required for this item.

Condition: A resident exited the basement classroom, traveled to the first
floor, then traveled to
the basement recreation room, all without direct supervision of a Resident
Advisor.
Among other methods one feasible and acceptable abatement method to
correct this hazard is to adhere to the
Maryland Department of Juvenile Services Policy & Procedure, Youth
Movement and Count, RF-02-06,
effective date January 17, 2006, 4-6-5 which states youth will not be
allowed to move freely without the direct
supervision of a designated facility employee.
Abatement documentation (photographs, receipts, copies of programs,
training certification, etc.)
is required for this item.

Condition:Physical counts of all residents were not conducted, from 5:00
pm to 10:00 pm, when
a count every 30 minutes is required.
(b)Date of Violation:02/18/10
Location:Murphy Cottage/Re-Direct Unit
Condition:Physical counts of all residents were not conducted, from 7:30
am to 2:00 pm when, a
count every 30 minutes is required.
Among other methods, one feasible and acceptable abatement method to
correct
this hazard is adhering to the
Maryland Department of Juvenile Services Policy & Procedure, Youth
Movement and Counts, RF-02-06,
Effective Date January 17, 2006, 4-a-3 which states the Resident Advisor
shall conduct counts every 30
minutes and call the count into the Command Center/Master Control/ Tour
Office. The count must be logged
into the unit logbook within 15 minutes of the count.

Condition:Teachers and other staff were not logged into or out of the
unit, nor did they sign in
upon their arrival, or sign out upon their exit.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is adhering to the
Maryland Department of Juvenile Services Policy & Procedure, General
Documentation of Log Books, RF-02-
05, effective date August 28, 2006, 4-c-13-ii which states the names  of
all employees assigned to the unit for
all shifts, along with the signature of each employee shall be entered in
the logbook. The logbook is used to
document all events occurring during the shift, regardless of the nature,
involving youth, employees or
visitors.
(b)Date of Violation:02/17/10
Location:Murphy Cottage/Re-Direct Unit
Condition:Resident Advisors did not enter the movement of a resident, from
the first floor to the
basement, to meet with a teacher into the log book, nor did the Resident
Advisors
enter the return of the resident to the Recreation Room into the log book.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is to adhere to the
Maryland Department of Juvenile Services Policy & Procedure, General
Documentation of Log Books, RF-05-
06, effective date August 28, 2006, 4-e-2-v which states employees are
responsible for making log book
entries relevant to, but not limited to, all youth movements from one
destination to another.
